SYMTRIBE TERMS OF USE AND DISCLAIMER Effective date: June 21, 2026 Version: 4.0 IMPORTANT: PLEASE READ CAREFULLY. BY CREATING AN ACCOUNT, CLICKING THE TERMS CHECKBOX, ACCEPTING UPDATED TERMS, OR CONTINUING TO USE SYMTRIBE AFTER YOU ARE ASKED TO ACCEPT UPDATED TERMS, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THESE TERMS OF USE AND DISCLAIMER. IF YOU DO NOT AGREE, DO NOT CREATE AN ACCOUNT, DO NOT ACCEPT THESE TERMS, AND DO NOT USE SYMTRIBE. These terms are intended to protect SymTribe and its owner/operator to the maximum extent permitted by applicable law. Nothing in these terms excludes, limits, waives, releases, or transfers liability where doing so is not permitted by mandatory law. 1. WHAT SYMTRIBE IS SymTribe is a technology platform that helps users discover and connect with other users who may want to participate in similar group activities. SymTribe is not an event organizer, activity operator, tour operator, guide, supervisor, instructor, coach, trainer, dog handler, dog trainer, route planner, transportation provider, emergency service, veterinary service, medical adviser, safety authority, venue operator, or equipment provider. SymTribe does not organize, lead, supervise, inspect, approve, train, screen, control, or manage any activity, participant, dog, handler, route, location, venue, equipment, weather condition, public-space condition, third-party act, or interaction between users. Any matching result, invitation, reminder, meeting point, location suggestion, preference field, activity label, route or place reference, group feature, notification, or other platform output is a technical facilitation feature only. It is not safety approval, professional advice, route planning, suitability confirmation, supervision, or an undertaking by SymTribe to control what happens offline. 2. AGE REQUIREMENT You must be at least 18 years old to create an account or use SymTribe. By using SymTribe, you represent that you are at least 18 years old. SymTribe may ask you to provide your self-declared date of birth and may use it to check adult account eligibility. This self-declared date-of-birth check is not documentary, biometric, identity, background, or age verification, and SymTribe does not verify that any user-entered date of birth is true. If you bring, supervise, or are responsible for a child or minor at an activity, you are solely responsible for that child or minor, including deciding whether the activity is suitable, lawful, and safe for them. SymTribe does not supervise children or minors. 3. YOUR RESPONSIBILITY You are solely responsible for your own decisions, conduct, preparation, communications, participation, and compliance with law. You must independently decide whether to attend, continue, leave, cancel, decline, or report any activity or interaction. You are responsible for: - evaluating whether an activity, group, participant, dog, handler, venue, meeting point, route, public space, time, weather condition, equipment, or other circumstance is suitable for you; - acting with reasonable care toward yourself, other users, animals, property, bystanders, and the public; - complying with all applicable laws, regulations, bylaws, park rules, venue rules, traffic rules, leash and muzzle rules, licensing rules, vaccination rules, environmental rules, and activity-specific rules; - bringing and properly using safe, lawful, and well-maintained equipment; - leaving or declining any activity if you believe it is unsafe, unlawful, unsuitable, or uncomfortable; - obtaining any license, permit, training, certification, insurance, medical clearance, or other authorization required or recommended for your activity, location, dog, vehicle, equipment, or personal circumstances. 4. ASSUMPTION OF INHERENT RISKS In-person group activities involve inherent and unpredictable risks. To the maximum extent permitted by applicable law, you voluntarily assume the risks arising from your use of SymTribe and your participation in any activity or interaction connected to SymTribe. These risks include, without limitation: - bodily injury, illness, disability, emotional distress, or death; - damage to, loss of, or theft of property; - animal injury, illness, escape, or death; - falls, collisions, traffic incidents, route errors, getting lost, dehydration, heat illness, cold exposure, fatigue, overexertion, allergic reactions, and medical events; - equipment failure, misuse, poor maintenance, incompatible equipment, or lack of protective equipment; - dangerous terrain, slippery surfaces, poor visibility, darkness, water, cliffs, rocks, roots, holes, mud, sand, gravel, stairs, walls, obstacles, vehicles, bicycles, scooters, motorcycles, animals, wildlife, insects, parasites, plants, weather, lightning, wind, flooding, heat, cold, and other environmental or public-space hazards; - acts or omissions of users, dog owners, dog handlers, venue staff, drivers, pedestrians, cyclists, bystanders, authorities, landowners, and other third parties; - criminal, abusive, unsafe, offensive, negligent, reckless, or intentional conduct by other people. 5. NO GUARANTEES SymTribe does not guarantee safety, suitability, compatibility, legality, availability, attendance, punctuality, conduct, health, fitness, skill, training, temperament, insurance, equipment, route quality, venue quality, meeting point quality, weather, public-space conditions, or the accuracy, completeness, currency, or reliability of any user-provided, platform-provided, or third-party information. SymTribe does not guarantee that any user, dog, handler, group, activity, venue, meeting point, route, or location is safe, lawful, appropriate, or compatible with you, your dog, your equipment, your health, your abilities, or your expectations. 6. NO BACKGROUND CHECKS OR VERIFICATION SymTribe's self-declared date-of-birth check is limited to assessing whether the date entered indicates that the account holder is at least 18 years old. Unless SymTribe expressly states otherwise in a specific feature, SymTribe does not conduct background checks and does not verify any user's identity, age, date of birth, criminal history, intentions, skill, training, qualifications, health, fitness, experience, insurance, equipment, legal compliance, dog ownership, dog handling ability, dog health, dog vaccination, dog license, dog training, dog temperament, dog breed, dog legal status, or dog suitability. You must not rely on SymTribe to inspect, approve, verify, or monitor users, dogs, handlers, equipment, locations, routes, venues, or activities. 7. MEDICAL, FITNESS, EQUIPMENT, LEGAL COMPLIANCE, AND INSURANCE You are responsible for determining whether you are medically and physically fit to participate. Consult a qualified medical professional before participating if you have any medical condition, disability, pregnancy, medication concern, injury, allergy, cardiovascular risk, heat or cold sensitivity, or other concern that could affect participation. You are responsible for selecting, inspecting, maintaining, and using appropriate equipment and protective gear. This may include helmets, lights, reflective gear, footwear, water, food, weather protection, maps, charged phones, first-aid supplies, climbing equipment, dog leash, collar, harness, muzzle, waste bags, medication, and any activity-specific equipment. You are responsible for complying with all laws and rules that apply to your activity and location. This includes traffic laws, park and trail rules, venue rules, licensing, registration, permit, vaccination, leash, muzzle, dangerous dog, vehicle, land-use, environmental, and insurance requirements. You are responsible for carrying appropriate insurance where required or recommended, including health, accident, personal liability, dog owner or dog handler liability, vehicle, travel, or activity-specific insurance. SymTribe does not provide insurance for you, your dog, your vehicle, your equipment, or your participation. 8. MEETING STRANGERS AND USER DISPUTES SymTribe may help you meet people you do not know. Meeting strangers carries interpersonal and personal-safety risks. Use your own judgment, meet in public places when appropriate, tell someone where you are going when appropriate, and leave any interaction that feels unsafe or unsuitable. Your disputes with other users, dog owners, dog handlers, venues, landowners, drivers, pedestrians, bystanders, or other third parties are between you and those parties. SymTribe is not responsible for resolving, supervising, or controlling user disputes, though SymTribe may choose to review reports or take platform action at its discretion. 9. LOCATIONS, ROUTES, WEATHER, TRAFFIC, PUBLIC SPACES, AND THIRD PARTIES Meeting points, place names, venue names, maps, location suggestions, city references, route references, and other location information may be incomplete, approximate, outdated, user-submitted, generated, or affected by third-party data. SymTribe does not represent that any place is open, lawful to access, safe, suitable, staffed, dog-friendly, child-friendly, traffic-safe, accessible, or appropriate for any activity. You must independently check the actual place, route, access rights, opening hours, weather, daylight, traffic, terrain, local restrictions, venue rules, park rules, emergency access, and other circumstances before and during an activity. 10. ACTIVITY-SPECIFIC TERMS The following sections apply to the activities currently supported by SymTribe. They are not exhaustive. Similar or additional risks may apply to any activity. Activity-specific terms: Cycling Cycling may involve roads, cycle paths, shared paths, parks, trails, traffic, vehicles, pedestrians, other cyclists, speed, mechanical failure, poor visibility, road defects, weather, falls, collisions, and serious injury or death. You are responsible for obeying traffic laws, using lawful and well-maintained bicycle equipment, choosing suitable routes and conditions, wearing appropriate protective gear, using lights and visibility equipment where required or prudent, and riding within your ability. SymTribe does not inspect bicycles, verify riding skill, select or approve routes, control traffic, or supervise rides. Activity-specific terms: Running Running may involve roads, crossings, trails, parks, public spaces, traffic, uneven surfaces, poor lighting, heat, cold, dehydration, overexertion, cardiac or medical events, falls, collisions, and interaction with strangers. You are responsible for deciding whether the pace, distance, surface, group, weather, daylight, route, and your health are suitable. SymTribe does not verify pace, fitness, route safety, surface conditions, or medical readiness. Activity-specific terms: Hiking Hiking may involve trails, cliffs, rocks, steep or exposed terrain, mud, water, remote areas, poor phone coverage, weather changes, heat, cold, dehydration, getting lost, wildlife, insects, falling branches, falling rocks, darkness, and delayed rescue. You are responsible for selecting lawful and marked trails or permitted routes, checking weather and daylight, bringing water, food, navigation, clothing, and emergency supplies, and turning back when conditions are unsafe. SymTribe does not guide hikes, inspect trails, provide rescue, or verify that a hike is suitable for your ability. Activity-specific terms: Dirt Biking Dirt biking and off-road riding may involve speed, motorized or non-motorized vehicles, rough terrain, jumps, sand, gravel, mud, dust, obstacles, mechanical failure, collisions, environmental restrictions, land-access restrictions, traffic rules, licensing, registration, insurance, noise rules, and serious injury or death. You are responsible for ensuring that your vehicle, equipment, protective gear, license, registration, insurance, route, land access, and participation are lawful and suitable. Do not ride in prohibited areas, closed trails, protected areas, private land without permission, or any place where your activity is not allowed. SymTribe does not provide vehicles, inspect vehicles, approve riding areas, supervise riding, or verify licenses, insurance, or land access. Activity-specific terms: Family Hikes Family Hikes may involve all hiking risks plus risks specific to children and minors, including supervision gaps, fatigue, dehydration, heat or cold sensitivity, falls, traffic, water, animals, strangers, child-specific medical needs, and routes that are not suitable for a child's age, ability, attention, or equipment. The adult user who brings or supervises a child is solely responsible for that child, including continuous supervision, route selection, equipment, food, water, clothing, medical needs, transport, and deciding whether to start, continue, or leave. SymTribe does not supervise children, verify family suitability, or approve child-safe routes. Activity-specific terms: Indoor Climbing Indoor climbing may involve bouldering, top-rope climbing, lead climbing, auto-belay use, belaying, falling, dropped objects, wall or hold conditions, mat conditions, rope or harness errors, knot errors, belay-device errors, carabiner errors, incompatible equipment, weight differences between climbing partners, poor communication, distraction, venue rules, and serious injury or death. You are responsible for using only lawful venues, following venue rules, obtaining any required gym certification or belay approval, checking your partner, checking knots, harnesses, belay devices, carabiners, ropes, mats, auto-belays, and other equipment, and climbing only within your ability and training. SymTribe does not operate climbing gyms, inspect venues, certify belayers, verify climbing skill, provide instruction, or supervise climbing sessions. Activity-specific terms: Dog Walk Dog Walk involves all public-space and meeting-strangers risks plus animal behavior risks. Dogs can react unpredictably even when previously friendly, trained, leashed, muzzled, familiar, healthy, or calm. Dog Walk risks include, without limitation: - dog bites and dog scratches; - dog fights and dog-on-dog injuries; - injury, illness, disability, or death to humans; - injury, illness, escape, or death to dogs or other animals; - property damage, including damage to clothing, phones, bicycles, vehicles, homes, parks, venues, or other property; - leash, collar, harness, muzzle, clip, gate, fence, carrier, or handling failures; - escaped dogs, lost dogs, dogs running into traffic, and traffic incidents involving dogs; - disease, parasite, or allergen transmission, including contact with saliva, feces, urine, blood, ticks, fleas, or contaminated surfaces; - dogs that are aggressive, reactive, fearful, anxious, untrained, poorly socialized, sick, injured, in heat, too young, too old, legally restricted, unsuitable for group walks, or unsuitable for the specific location or other dogs present. Each dog owner or handler is responsible for controlling their dog at all times and for deciding whether the dog should attend, approach, interact, remain separate, wear a muzzle, stay on leash, leave, or not participate. Each dog owner or handler is responsible for following all leash, muzzle, licensing, microchip, vaccination, dangerous-dog, restricted-breed, waste-cleanup, public-space, transport, venue, and local rules. Each dog owner or handler is responsible for carrying appropriate dog liability insurance where required or recommended. SymTribe does not inspect, approve, train, supervise, control, handle, walk, transport, board, separate, restrain, verify, or certify any dog or handler. SymTribe does not verify dog ownership, handling ability, training, insurance, license, vaccination, health, temperament, breed, legal status, muzzle use, or suitability. SymTribe does not guarantee dog compatibility, safe dog introductions, safe dog play, safe dog walking, or safety from dog-related harm. As between you and SymTribe, and to the maximum extent permitted by applicable law, the dog owner or handler is responsible for any claim, harm, injury, death, illness, loss, or damage caused by their dog, their handling, their equipment, their legal violation, or their decision to bring or continue with a dog. 11. EMERGENCIES SymTribe is not an emergency service and does not monitor activities in real time. In an emergency, call the appropriate local emergency number, police, ambulance, fire service, mountain rescue, veterinary emergency service, animal control authority, or other qualified professional. In Europe, the emergency number is commonly 112. In Israel, police, ambulance, fire, municipal veterinary, and other emergency contacts may differ by situation. Do not rely on SymTribe messages, reports, support, moderation, or platform features for emergency response. 12. PLATFORM AVAILABILITY AND INFORMATION The platform is provided on an "as is" and "as available" basis. SymTribe may be unavailable, delayed, inaccurate, incomplete, interrupted, or changed. To the maximum extent permitted by applicable law, SymTribe disclaims all warranties and representations, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, reliability, and suitability. 13. LIMITATION OF LIABILITY To the maximum extent permitted by applicable law, SymTribe and its owner/operator, officers, directors, employees, contractors, agents, affiliates, successors, and assigns will not be liable for: - user conduct or user content; - dog behavior, dog handling, dog ownership, dog equipment, dog injury, dog illness, dog escape, dog death, or dog-related damage; - activity participation, route choice, location choice, venue choice, equipment choice, weather conditions, traffic, public-space conditions, third-party acts, or emergency response; - indirect, incidental, special, consequential, exemplary, or punitive damages; - loss of profit, revenue, goodwill, data, opportunity, or expected benefit; - bodily injury, death, emotional distress, property damage, animal injury, or animal death, except where liability cannot legally be excluded or limited. To the maximum extent permitted by applicable law, SymTribe's total aggregate liability for any claim arising from or related to these terms, the platform, or any activity connected to the platform will not exceed the greater of: - the amount you paid to SymTribe for the service giving rise to the claim in the twelve months before the event giving rise to the claim; or - EUR 100. Mandatory-law carve-outs: nothing in these terms excludes or limits liability for intentional misconduct, fraud, fraudulent concealment, liability for guarantees where legally binding, gross negligence where exclusion or limitation is prohibited, death or personal injury where exclusion or limitation is prohibited, product liability where applicable and non-excludable, liability under mandatory consumer protection law, or any other liability that cannot be excluded, limited, released, waived, or transferred under applicable law. 14. RELEASE OF CLAIMS To the maximum extent permitted by applicable law, you release SymTribe and its owner/operator, officers, directors, employees, contractors, agents, affiliates, successors, and assigns from claims, demands, damages, losses, liabilities, costs, and expenses arising from or related to: - your participation or non-participation in any activity; - your interaction with users, dogs, handlers, venues, landowners, drivers, pedestrians, bystanders, authorities, or other third parties; - user conduct, dog behavior, dog handling, route choice, location choice, equipment, weather, traffic, public-space conditions, third-party acts, or emergency response. This release does not apply where release is not permitted by mandatory law. 15. INDEMNIFICATION To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless SymTribe and its owner/operator, officers, directors, employees, contractors, agents, affiliates, successors, and assigns from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising from or related to: - your conduct, omissions, content, communications, or use of SymTribe; - your participation in, organization of, invitation to, or cancellation of any activity; - your interaction or dispute with any user or third party; - your dog, your handling of a dog, your dog equipment, your dog's behavior, your dog's legal status, or any harm caused by your dog; - your vehicle, bicycle, climbing equipment, protective gear, or other equipment; - your violation of these terms, any law, any venue rule, any park rule, any traffic rule, any leash or muzzle rule, any licensing or vaccination rule, or any third-party right. This indemnity does not require you to indemnify SymTribe for liability that cannot legally be transferred to you, including SymTribe's intentional misconduct, fraud, or other non-indemnifiable liability under applicable law. 16. PRIVACY AND CONSENT DATA When you accept these terms, SymTribe records your acceptance to maintain a verifiable consent record. The record may include your user account, the disclaimer version, the content hash of the accepted text, acceptance timestamp, IP address, user agent, locale, and acceptance method. Consent records are tied to your account. In the current application behavior, when you delete your account, your consent records are permanently removed along with your other account data. No post-deletion consent retention period applies in the current application behavior. For more information about personal data handling, see the Privacy Policy. 17. CHANGES TO THESE TERMS SymTribe may update these terms. If SymTribe makes material changes or marks a new disclaimer version as current, SymTribe may require renewed acceptance before you can continue using authenticated platform features. Your acceptance of the updated version creates a new consent record tied to that version and content hash. 18. GOVERNING LAW, VENUE, AND MANDATORY CONSUMER RIGHTS Where permitted by applicable law, these terms are governed by the laws of the jurisdiction where the SymTribe owner/operator is established, without prejudice to mandatory conflict-of-law rules and mandatory consumer protection rules. Nothing in these terms deprives you of mandatory rights you may have under the law of your place of residence, including mandatory European Union, German, or Israeli consumer, tort, data protection, venue, jurisdiction, or other non-excludable rights. If a court or authority finds that a governing-law, venue, liability, release, indemnity, waiver, limitation, or dispute provision cannot be enforced against you under mandatory law, that provision applies only to the maximum enforceable extent. 19. SEVERABILITY If any provision of these terms is found unenforceable, invalid, or unlawful, that provision will be modified to the minimum extent necessary to make it enforceable if permitted by law.
